Mutation of land is 

the process of updating the official government land revenue records to reflect a change in property ownership. This procedure is also known as Dakhil Kharij in Hindi. It is required after a property has been transferred through a sale, inheritance, gift, or partition. 

Why land mutation is important

While a registered sale deed or title deed establishes legal ownership, mutation is a critical administrative step that updates government records for several key reasons: 

  • Property tax assessment: It ensures that the new owner is liable for property taxes and that tax records are accurate.
  • Evidence of ownership: A mutation certificate provides supporting evidence of ownership for administrative and fiscal purposes. It is often required for future transactions.
  • Prevents fraud and disputes: Up-to-date land records prevent confusion and help to avoid ownership disputes or fraudulent transactions by creating a clear chain of ownership.
  • Required for utilities: Many municipal services, such as water and electricity connections, require a valid mutation record to be transferred to the new owner.
  • Essential for property resale: An updated mutation record is often mandatory for future sales, as potential buyers and financial institutions will require it for verification.
  • Government compensation: In the case of land acquisition by the government, compensation is paid to the person whose name is on the mutation documents. 

Mutation vs. Property Registration

It is important to understand that mutation is different from property registration. 

  • Property Registration: This is the legal process of recording a transaction with the sub-registrar’s office. It requires the payment of stamp duty and registration fees and legally transfers the ownership title from the seller to the buyer by creating a sale deed.
  • Property Mutation: This is an administrative process that follows property registration. It involves updating the new owner’s name in the land revenue department’s records for taxation purposes and is carried out by the local municipal body or revenue department. 

Process for land mutation

The specific process for mutation can vary by state, but it generally follows these steps: 

  1. Obtain documents: Gather necessary documents, which can include the sale deed, property tax receipts, identity proof, an application form, and, in cases of inheritance, a death certificate and succession certificate.
  2. Submit application: Submit the application and documents to the local municipal office or land revenue department. Many states now offer online portals for this process.
  3. Pay fees: Pay the required mutation fee, which varies by state and may depend on the property’s value.
  4. Verification: The authorities will verify the documents and may perform a physical inspection of the property.
  5. Issuance of certificate: Once the request is approved, the updated records are made and a mutation certificate is issued to the owner. 

Legal standing

The Supreme Court of India has ruled that a mutation entry does not create or extinguish a property title; it is merely an entry for fiscal purposes. Legal ownership is established by the registered title deeds. If there is a dispute regarding ownership, the party claiming the property must seek a ruling from a civil court.
